These General Terms and Conditions apply to the Agreement between the Entrepreneur and the Parent.<\/p>\n<\/section>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;ARTICLE 3 \u2013 Cancellation and withdrawal&#8221; _builder_version=&#8221;4.27.5&#8243; _module_preset=&#8221;default&#8221; open=&#8221;off&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<section class=\"voorwaarden-artikel\" id=\"artikel-3\">1. In any case, the Parent has the right to cancel the Agreement under the following conditions:<\/p>\n<p>a. The Parent may cancel the Agreement from the Effective Date until the Commencement Date. <\/p>\n<p>b. In the event that the Parent cancels less than one month before the Commencement Date, the Entrepreneur may charge cancellation fees up to a maximum of the amount the Parent owes for one month of Childcare. <\/p>\n<p>c. In the event that the Parent cancels more than one month before the Commencement Date, the Parent may owe compensation to the Entrepreneur for costs that the Entrepreneur has already actually incurred for the execution of the Agreement. <\/p>\n<p>2. In the event that the Agreement was concluded at a distance (for example, via the internet or post), the Parent has the right of withdrawal under the following conditions:<\/p>\n<p>a. The Parent may dissolve the Agreement free of charge, without giving reasons, within fourteen days after the day the Agreement was concluded. This is called the right of withdrawal.  <\/p>\n<p>b. If the dissolution occurs before the Commencement Date, the Parent will receive a full refund of the costs paid. If the dissolution occurs after the Commencement Date and Childcare has already been used, the Parent will receive a refund of the costs paid, minus the costs related to and proportional to the Childcare already used.  <\/p>\n<p>c. The Parent can exercise the right of withdrawal by making an unambiguous statement to the Entrepreneur wishing to dissolve the Agreement. The Parent can also use the model form included in Annex 2 for this purpose, but this is not mandatory.  <\/p>\n<\/section>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;ARTICLE 4 \u2013 Intake interview&#8221; _builder_version=&#8221;4.27.5&#8243; _module_preset=&#8221;default&#8221; open=&#8221;off&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<section class=\"voorwaarden-artikel\" id=\"artikel-4\">\n<p>1. The Entrepreneur will invite the Parent for an intake interview in good time before the Commencement Date.<\/p>\n<p>2. The following matters will be discussed during this intake interview:<\/p>\n<p>a. The specific details of the Parent and their child required for the Childcare; including the necessary citizen service number(s) (BSN); <\/p>\n<p>b. The start and duration of the settling-in period; <\/p>\n<p>c. General or temporary points of attention and specifics for the specific care of the child (daily rhythm, nutrition, illness, medication, development, and the like); <\/p>\n<p>d. The individual wishes of the Parent and that these will be taken into account as far as reasonably possible; <\/p>\n<p>e. The method of communication; <\/p>\n<p>f. Going on outings; <\/p>\n<p>g. Taking photos and\/or videos of the child; <\/p>\n<p>h. The Parent&#8217;s legal liability for damage caused by their child; <\/p>\n<p>i. In the case of After-school care: the elements mentioned in Annex 1 to these General Terms and Conditions, under 5 sub h. <\/p>\n<p>3. The Entrepreneur will confirm the agreements made during the intake interview In Writing to the Parent.<\/p>\n<\/section>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;ARTICLE 5 \u2013 Duration and extension of the Agreement&#8221; _builder_version=&#8221;4.27.5&#8243; _module_preset=&#8221;default&#8221; open=&#8221;off&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<section class=\"voorwaarden-artikel\" id=\"artikel-5\">\n<p>1. The Agreement is entered into for the following term based on the agreed type of Childcare:<\/p>\n<p>a. for Daycare until the day the child reaches the age of four; <\/p>\n<p>b. for After-school care until the day the child reaches the age of twelve.<\/p>\n<p>2. In deviation from the provisions in paragraph 1, Parties may agree on a shorter or longer duration.<\/p>\n<p>3. After the term of an Agreement has expired, Parties may extend the Agreement. An extension of the Agreement is agreed upon In Writing. Extension does not take place tacitly.  <\/p>\n<\/section>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;ARTICLE 6 \u2013 End of the agreement&#8221; _builder_version=&#8221;4.27.5&#8243; _module_preset=&#8221;default&#8221; open=&#8221;off&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<section class=\"voorwaarden-artikel\" id=\"artikel-6\">\n<p>1. The Agreement ends by operation of law upon the expiry of the term included in the Agreement.<\/p>\n<p>2. In addition, the Agreement ends through (interim) termination by one of the Parties.<\/p>\n<p>3. Parties intend for the Agreement to be terminable:<\/p>\n<p>a. The Parent is always authorized to terminate the Agreement. <\/p>\n<p>b. The Entrepreneur is only authorized to terminate the Agreement on the basis of a valid reason. Valid reasons include in any case:  <\/p>\n<p>i. The situation where the Parent is in default regarding their payment obligation for two (or more) months of Childcare; <\/p>\n<p>ii. Situations as mentioned in Article 10 paragraph 2 sub a and b(ii) that continue for two months (or longer); <\/p>\n<p>iii. The situation mentioned in Article 10 paragraph 2 sub b(i); <\/p>\n<p>iv. The situation where the (trust) relationship between Entrepreneur and Parent is disrupted, making continuation of the Agreement in its unchanged form unreasonable for the Entrepreneur; <\/p>\n<p>v. The circumstance that the Entrepreneur is no longer able to execute the Agreement due to an unforeseen circumstance or a cause not attributable to them; <\/p>\n<p>vi. A business economic necessity that endangers the continuity (of a location where the child is placed). <\/p>\n<p>4. Termination takes place by means of a Written statement addressed to the other Party. The Entrepreneur will provide reasons for the termination. The Parent does not need to provide reasons for the termination.  <\/p>\n<p>5. The Entrepreneur and the Parent may terminate the Agreement observing the following notice period:<\/p>\n<p>a. The Parent can terminate with a notice period of one month. In the case of Article 11 paragraph 8, no notice period applies to the Parent;  <\/p>\n<p>b. The Entrepreneur can terminate observing a reasonable period, which is at least one month; <\/p>\n<p>c. The Entrepreneur can terminate with immediate effect in a case as referred to in Article 6 paragraph 3 under b. under i; <\/p>\n<p>d. The Parent can terminate with immediate effect in the event that the Entrepreneur terminates. <\/p>\n<p>6. The notice period starts on the date the Parent or the Entrepreneur received the notice of termination. The statement is deemed to have been received on the date of the postmark on the envelope of the termination letter, on the date of the email with which the statement was sent, or on the date the electronic statement was sent, unless a later date is mentioned in the statement. <\/p>\n<p>7. During the notice period, the Entrepreneur is obliged to provide Childcare and the Parent is obliged to pay the fee for the Childcare (the price).<\/p>\n<p>8. In the event of the child&#8217;s death, the Agreement ends with immediate effect.<\/p>\n<\/section>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;ARTICLE 7 \u2013 Mutual obligations&#8221; _builder_version=&#8221;4.27.5&#8243; _module_preset=&#8221;default&#8221; open=&#8221;off&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<section class=\"voorwaarden-artikel\" id=\"artikel-7\">\n<p>1. Parties will jointly ensure an adequate exchange of information about the child.<\/p>\n<p>2. Parties transfer responsibility for the child to each other in the following manner:<\/p>\n<p>a. For Daycare: the Parent is responsible for the child when dropping them off and the Entrepreneur when they are picked up, until the moment parties can reasonably assume that the transfer of responsibility has actually taken place. <\/p>\n<p>b. For After-school care: the way the child arrives at and leaves the After-school care determines the transfer of responsibility for the child. Parties make Written agreements about this.  <\/p>\n<\/section>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;ARTICLE 8 \u2013 Obligations of the Entrepreneur&#8221; _builder_version=&#8221;4.27.5&#8243; _module_preset=&#8221;default&#8221; open=&#8221;off&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<section class=\"voorwaarden-artikel\" id=\"artikel-8\">\n<p>1. Under the Agreement, the Entrepreneur is bound to provide Childcare under the conditions agreed upon therein and in these General Terms and Conditions.<\/p>\n<p>2. The Entrepreneur guarantees that:<\/p>\n<p>a. The Childcare taking place under their responsibility: <\/p>\n<p>i. complies with applicable laws and regulations; <\/p>\n<p>ii. is performed in accordance with the requirements of good craftsmanship and using sound materials; <\/p>\n<p>b. A Childcare Center falling under their responsibility is suitable for responsible childcare, both in terms of personnel and material facilities. Further regulations on how the Entrepreneur fulfills their obligations mentioned in Article 8 paragraph 1 are laid down in Annex 1. This annex forms an integral part of these General Terms and Conditions.   <\/p>\n<p>c. They comply with laws and regulations. <\/p>\n<p>3. The Entrepreneur takes the individual wishes of the Parent into account as far as reasonably possible.<\/p>\n<\/section>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;ARTICLE 9 \u2013 Obligations of the Parent&#8221; _builder_version=&#8221;4.27.5&#8243; _module_preset=&#8221;default&#8221; open=&#8221;off&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<section class=\"voorwaarden-artikel\" id=\"artikel-9\">\n<p>1. The Parent reports specifics of a medical nature or in the child&#8217;s development at the time of registration.<\/p>\n<p>2. The Parent ensures that the Entrepreneur has all the data important for reaching the Parent.<\/p>\n<p>3. The Parent adheres to the rules applicable within the Childcare Center.<\/p>\n<p>4. The Parent refrains from behavior that poses a risk or threat to the mental and\/or physical health or safety of others and\/or hinders or disproportionately burdens the Entrepreneur&#8217;s service provision to (the children of) other Parents. The Parent ensures that their child also refrains from this. <\/p>\n<p>5. The Parent drops off and picks up the child on time and ensures compliance with this obligation by others who drop off and pick up the child on their behalf.<\/p>\n<p>6. The Entrepreneur records the authority of persons other than the Parents to pick up the child from Childcare In Writing if the Parent so requests.<\/p>\n<p>7. The Parent pays the Entrepreneur in accordance with the agreements made in the Agreement and within the payment term, or at least bears responsibility for this.<\/p>\n<\/section>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;ARTICLE 10 \u2013 Accessibility&#8221; _builder_version=&#8221;4.27.5&#8243; _module_preset=&#8221;default&#8221; open=&#8221;off&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<section class=\"voorwaarden-artikel\" id=\"artikel-10\">\n<p>1. The location where the child is placed is, in principle, accessible to the child.<\/p>\n<p>2. The Entrepreneur has the right to refuse the child and\/or the Parent access to the location for the duration of the period that normal care of the child cannot reasonably be expected from the Entrepreneur and the child cannot be cared for in the usual way. For example because: <\/p>\n<p>a. The child has an extra care need due to illness or otherwise that: <\/p>\n<p>i. the Entrepreneur is legally not allowed to provide; or <\/p>\n<p>ii. exceeds the individual healthcare agreed upon in the Agreement (see Article 8 paragraph 1); or <\/p>\n<p>iii. the Entrepreneur is factually unable to provide properly. <\/p>\n<p>b. The child and\/or the Parent (i) poses a risk or threat to the mental and\/or physical health or safety of others and\/or (ii) hinders or disproportionately burdens the Entrepreneur&#8217;s service provision to (the children of) other Parents. Before the Entrepreneur refuses access on this ground, the Entrepreneur warns the Parent, unless a warning cannot reasonably be required due to the severity or urgency;    <\/p>\n<p>c. The (trust) relationship between Entrepreneur and Parent is disrupted, making continuation of the Agreement in its unchanged form unreasonable for the Entrepreneur. <\/p>\n<p>3. In the event the Entrepreneur refuses the child and\/or the Parent access to the location, the Entrepreneur will consult with the Parent to find a solution for the situation that is acceptable to all Parties.<\/p>\n<p>4. If the Parent does not agree with a decision to refuse access based on Article 10 paragraph 2 and the consultation with the Entrepreneur has not led to a solution, they can submit this decision to the Disputes Committee with the request to handle the dispute according to the shortened procedure as referred to in the Regulations of the Childcare Disputes Committee.<\/p>\n<p>5. During the shortened procedure, the Entrepreneur may not terminate the Agreement.<\/p>\n<\/section>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;ARTICLE 11 &#8211; The price and the change of the price&#8221; _builder_version=&#8221;4.27.5&#8243; _module_preset=&#8221;default&#8221; open=&#8221;off&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<section class=\"voorwaarden-artikel\" id=\"artikel-11\">\n<p>1. The price the Parent must pay for the Childcare from the Commencement Date is included in the Agreement.<\/p>\n<p>2. Changes to the agreed price take place observing the provisions in Article 11 paragraphs 3 to 8.<\/p>\n<p>3. The Entrepreneur may change (including increase) the agreed price once per calendar year and, in the case of an increase in the agreed price, for the first time no earlier than after at least three months have passed since the Effective Date.<\/p>\n<p>4. Reasons for the price change include changes in costs and other factors regarding the Entrepreneur&#8217;s business operations, as further specified in Annex 3.<\/p>\n<p>5. The Entrepreneur will notify the Parent of the price change In Writing before the changed price takes effect. The Entrepreneur will also state the date on which the changed price takes effect. The effective date for the changed price is at least 40 days after the day the price change was announced to the Parent.  <\/p>\n<p>6. Before the Entrepreneur proceeds to (announcing to the Parent) a change in the agreed price, (i) they will draw up a request for advice containing the intended price change decision provided with a supporting explanation, and (ii) they will enable the Parent Committee (or the combined Parent Committee), in accordance with Article 1.60 of the Childcare Act, to issue advice on the intended price change decision. With this request for advice and following any additional questions from the Parent Committee, the Entrepreneur will provide in writing all information that the Parent Committee reasonably needs to be able to issue advice on the intended price change decision. In the event the Entrepreneur is not legally obliged to establish a Parent Committee, the Entrepreneur will demonstrably involve the Parents sufficiently in another way in the intended price change decision.    <\/p>\n<p>7. The Entrepreneur can only deviate from the advice as referred to in Article 11 paragraph 6 if the Entrepreneur indicates in writing and with reasons that the interest of the Childcare opposes the advice. If the Parent Committee cannot agree with the deviation from the advice, it has the possibility to turn to the Disputes Committee. <\/p>\n<p>8. The Parent has the right (also) in the event of an (announced) price change to terminate the Agreement In Writing and without further motivation (see Article 6 paragraph 3 under a). If the Parent terminates in the 40 days before and 14 days after the effective date of the changed price, no notice period applies (see Article 6 paragraph 5 under a). <\/p>\n<\/section>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;ARTICLE 12 &#8211; Payment \/ Late payment&#8221; _builder_version=&#8221;4.27.5&#8243; _module_preset=&#8221;default&#8221; open=&#8221;off&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<section class=\"voorwaarden-artikel\" id=\"artikel-12\">\n<p>1. The Entrepreneur always provides a Written invoice and states on it the amount to be paid by the Parent (in accordance with the Agreement) and the final payment date. The invoice is provided free of charge. <\/p>\n<p>2. If a Parent pays a third party designated by the Entrepreneur, this counts as a discharging payment for the Parent. The designation by the Parent of a third party to take care of making payments does not stand in the way of the Parent&#8217;s liability for (timely) payment. Any payment by a third party for the Parent does count as a discharging payment by that Parent.  <\/p>\n<p>3. If payment has not been made by the final payment date stated on the invoice, the Entrepreneur will send a Written payment reminder to the Parent. In it, the Entrepreneur gives the Parent notice of default and gives the Parent the opportunity to still pay within 15 calendar days after receipt of this payment reminder. <\/p>\n<p>4. Furthermore, the Entrepreneur warns the Parent in the payment reminder of the authority to terminate based on Article 6 paragraph 3 under b under (i). This warning must have been sent to the Parent at least 14 days before the date on which the authority to terminate arises. <\/p>\n<\/section>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;ARTICLE 13 \u2013 Applicable law and competent court&#8221; _builder_version=&#8221;4.27.5&#8243; _module_preset=&#8221;default&#8221; open=&#8221;off&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<section class=\"voorwaarden-artikel\" id=\"artikel-13\">\n<p>1. Dutch law applies to the Agreement.<\/p>\n<p>2. The competent Dutch court is authorized to judge disputes between Parties in connection with the Agreement, notwithstanding the authority of the Disputes Committee to take cognizance of a dispute.<\/p>\n<\/section>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;ARTICLE 14 \u2013 Complaints procedure&#8221; _builder_version=&#8221;4.27.5&#8243; _module_preset=&#8221;default&#8221; open=&#8221;off&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<section class=\"voorwaarden-artikel\" id=\"artikel-14\">\n<p>1. Complaints about the execution of the Agreement must be submitted In Writing to the Entrepreneur. If the complaint is unclear or incomprehensible, the Parent will further explain the complaint at the request of the Entrepreneur. The Parent must submit the complaint within a reasonable time after they have discovered the defect in performance or reasonably should have discovered it within the meaning of Article 6:89 of the Dutch Civil Code.  <\/p>\n<p>2. The Entrepreneur handles the complaint in accordance with its internal complaints procedure. When drafting or changing this procedure, the Parent Committee has the right to advise in accordance with the provisions of the Childcare Act. <\/p>\n<p>3. If the complaint cannot be resolved amicably, a dispute arises that is subject to the dispute settlement procedure of Article 15.<\/p>\n<\/section>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;ARTICLE 15 \u2013 Dispute settlement and the legal complaints procedure for Childcare&#8221; _builder_version=&#8221;4.27.5&#8243; _module_preset=&#8221;default&#8221; open=&#8221;off&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<section class=\"voorwaarden-artikel\" id=\"artikel-15\">\n<p>1. Disputes between Parent and Entrepreneur about the formation or execution of the Agreement can be brought before the Childcare Disputes Committee (Geschillencommissie Kinderopvang), Bordewijklaan 46, PO Box 90 600, 2509 LP The Hague, by both the Parent and the Entrepreneur, observing the regulations applicable to the Disputes Committee (www.degeschillencommissie.nl).<\/p>\n<\/section>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;ARTICLE 16 \u2013 Governance code&#8221; _builder_version=&#8221;4.27.5&#8243; _module_preset=&#8221;default&#8221; open=&#8221;off&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<section class=\"voorwaarden-artikel\" id=\"artikel-16\">\n<p>1. There is a code to which the Entrepreneur is affiliated: the Childcare Governance Code. This can be found on the website www.kinderopvang.nl\/governance. The Parent can also request this from the Entrepreneur.  <\/p>\n<\/section>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;ARTICLE 17 \u2013 Changes&#8221; _builder_version=&#8221;4.27.5&#8243; _module_preset=&#8221;default&#8221; open=&#8221;off&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<section class=\"voorwaarden-artikel\" id=\"artikel-17\">\n<p>Changes to these General Terms and Conditions must be agreed upon between the Entrepreneur and the Parent.<\/p>\n<\/section>\n<p>[\/et_pb_accordion_item][et_pb_accordion_item title=&#8221;Annex 1&#8243; _builder_version=&#8221;4.27.5&#8243; _module_preset=&#8221;default&#8221; open=&#8221;off&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<\/p>\n<section class=\"voorwaarden-artikel\" id=\"bijlage-1\">\n<p>Further regulation of the Entrepreneur&#8217;s obligations from Article 8 of the General Terms and Conditions for Childcare \u2013 Daycare and After-school care 2024.<\/p>\n<p>The Entrepreneur fulfills their obligations mentioned in Article 8 paragraph 2 by ensuring, among other things, that they have:<\/p>\n<p>1. A pedagogical policy plan that describes the characteristic way of interacting with children and their parents;<\/p>\n<p>2. Regulations\/documents reflecting the policy regarding hygiene, safety, child abuse, medical actions, illness, and privacy;<\/p>\n<p>3. A regulation governing the functioning of the Parent Committee;<\/p>\n<p>4. A regulation governing the complaints procedure;<\/p>\n<p>5.
